What if I am fired after my injury?
It is unlawful in Washington State for an employee to be fired, suspended, or disciplined solely for filing a workers' compensation claim. However, an employer is not required to hold an injured workers’ position beyond what is required under the federal Family Medical Leave Act, or Washington Family Leave Act. If you feel you were discriminated against due to an injury sustained on the job, you should consult an attorney.
If an injured worker returns to light duty work while their claim is open, and they are later unable to resume the light duty work, or the employer terminates the light duty position, for no fault of the injured worker, the injured worker will likely be entitled to resume time-loss benefits.
